OFFICIAL CONTEST RULES

1. The “Celebrate in South Beach Contest” (the “Contest”) is sponsored by COTY CANADA Inc. (the “Sponsor”) and is administered by Faze Publications Inc. (the “Administrator”).

2. The Contest begins at approximately 3:00 pm ET on June 24th, 2010 and ends on August 1, 2010 at 11:59:59 pm ET (the “Contest Period”).

3. The Contest is open to all legal residents of Canada who are between the ages of 13 and 24 years at the time of entry. Parental consent to participate is required if entrant is under the age of majority in their province or territory of residence. Written confirmation of such consent may be required by Sponsor or Administrator at any time. Officers, directors and employees of the Sponsors, the Administrator, and their respective parent, affiliates, and related companies, advertising and promotional agencies, independent judging organization (if applicable), or parties engaged in the development, production and distribution of materials related to this Contest, and members of their immediate families (defined as parents, siblings, spouse and children, regardless of where they live) and/or persons living in the same household (whether related or not) are not eligible to participate.

4. NO PURCHASE NECESSARY.  A purchase will not increase your chances of winning. To enter go to www.faze.ca, click on the contest link and select “School’s Out! Celebrate in South Beach Contest”. Complete all mandatory fields in the online entry form, including name, address, age, city, postal code, phone number, and email address and submit as instructed. Entry deadline is August 1st, 2010 at 11:59:59 pm ET.

5. Limit one entry per person and per e-mail address per day.

6. PRIZING:
There are eleven (11) prizes available to be won (the ‘”Prizes”). The Prizes are more specifically described as follows:
One (1) Grand Prize;

  • Two (2) return economy airfare tickets from the major airport closest to the winner’s Canadian residence to Miami International Airport, Florida;
  • Three (3) nights hotel accommodation (double occupancy);
  • Breakfast, lunch and dinner for the winner and guest for the duration of the trip;
  • Up to USD$100 in credit, toward a spa experience (spa to be determined at sole discretion of Contest Sponsor).

If the potential winner of the Grand Prize is a minor (under the age of majority in the province/territory of residence), then a parent or legal guardian of the winner will also be required to complete and return the release documents prior to the minor being declared a winner, and the prize will be awarded in the name of the parent or legal guardian. Additionally, the parent or legal guardian must accompany the minor at all times. In such case, a complimentary travel package consisting of the same air travel, accommodation and meals as winner will be made available for one (1) parent or legal guardian to accompany the Grand Prize winner and guest.

If the winner’s guest is a minor (under the age of majority in the province/territory of residence), then the parent or legal guardian of the minor guest must give written permission prior to travel allowing that minor guest to travel with the winner and, if the winner is also a minor, her parent or legal guardian. Failure to obtain/provide such documentation may result in forfeiture of the prize.

Winner, guest (and, if applicable, parent/legal guardian) must have no restrictions on their ability to travel or prize may be forfeited, in whole or in part. Approximate retail value of the Grand Prize is $3,000 based on sample [Vancouver, BC] departure for two (2) people. Actual prize value depends on location of winner’s residence, number of persons, and dates of booking and departure. No compensation will be made or required if actual costs are lower or higher than this amount. 
Approximate retail value of each Secondary Prize Pack is $466. No compensation will be made or required if actual costs are lower or higher than this amount. 
Prizes must be accepted as awarded, has no cash equivalent, are not refundable or transferable and will not be substituted except in Sponsor’s sole discretion. Sponsor
reserves the right to substitute a prize of equal or greater monetary value in Sponsor’s sole discretion in the event the prize described is unavailable or cannot be awarded as described herein for any reason.

7. Selection Process:
On or about August 2nd, 2010 at approximately 3:00 pm ET in Toronto, Ontario, a random draw for each Prize will be conducted by the Administrator or its agents from all
eligible entries received during the Contest Period. The selected entrants will be contacted by telephone or email within approximately twenty-four (24) hours of the draw.

The odds of winning depend on the number of eligible entries received during the Contest Period. To be declared a winner, selected entrant must first correctly answer a mathematical, skill-testing question without assistance of any kind, whether mechanical or otherwise. The selected entrant (and, if entrant is a minor, the entrant’s parent/legal guardian) must also complete and return a written release and declaration form as outlined in Rule 10. The Grand Prize winner’s guest must also sign and return, prior to travel, a release and declaration form releasing the Sponsor and Administrator from liability with respect to the Contest and the Prize. Trip winner’s guest cannot be changed after the release and declaration form is received.

In the event the selected entrant cannot be contacted within seven (7) days of the first attempt of contact, fails to answer the skill-testing question correctly, is unable to travel on the dates required, does not return the release and declaration form by the dates required, or is otherwise non-compliant with these Official Rules, entrant may be disqualified at the sole discretion of the Administrator and another entrant may be selected who will be subject to disqualification on the same basis.

8. No correspondence pertaining to this Contest will be entered into except with potential winners. The Sponsor and Administrator accept no liability for printing errors on material distributed for this Contest.

9. THE GRAND PRIZE WINNER

  • It is the winner’s and the winner’s guest's responsibility to provide for any additional expenses not specifically included in the Prize as described herein, including, but not limited to, health and travel insurance, luggage fees, gratuities, return transportation between the winner's home and the major airport nearest her Canadian residence, return transportation between Miami International Airport and hotel in South Beach. A valid credit card may be required as a deposit for hotel incidentals.
  • The winner and guest (and parent/legal guardian if winner is a minor) are responsible for all necessary travel documentation including, without limitation, a passport, which must be valid prior to and for the duration of the trip. Sponsors and prize suppliers are not responsible in the event winner and/or guest are refused entry onto an aircraft, refused entry into another country or for re-entry into Canada, for any reason. Any unused portion of the Prize, as a result, will be forfeited (in whole or in part) and winner and/or guest will be solely responsible for any additional expenses.
  • The winner and guest (and parent/legal guardian if winner is a minor) must travel together on the same itinerary. Date of travel will be confirmed by Sponsors but will be taken on or around August 2010. Trip must be booked and taken on the dates and times specified by Administrator or its agent, or will be forfeited, in Sponsor’s or Administrator’s discretion. No responsibility is assumed by Sponsor or Administrator for canceled, delayed, suspended or re-scheduled events or travel for any reason whatsoever beyond its control and no compensation will be provided by Sponsor or Administrator in such an event. Transportation and accommodations are subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply.
  • The winner and the winner’s guest will be required to submit photos, video, written articles, blogs and/or videos of their trip. Publication is subject to the sole discretion of the Sponsor and/or Administrator. By accepting a prize, winner and winner’s guest agree to grant Sponsor and Administrator a non-exclusive royalty-free licence in perpetuity to copy, edit, publish, modify, reproduce, broadcast, communicate, adapt or otherwise use in any format, and in any media whatsoever (whether now known or hereafter devised), worldwide, in perpetuity, without any further notice or any right of approval or compensation or any claim arising out of any use, alteration, blurring, distortion, illusionary effect, faulty reproduction, or use in any composite form of winner or winner’s guest’s name, picture(s), likeness(es), voice(s) and/or biographical information. Winner and winner’s guest waive the benefit of any provision of law known as droit moral or moral rights or any similar or analogous law anywhere in the world.

10. Winner’s Release:  Before being declared a winner, the selected entrants (and their respective parent/legal guardian, if the entrant is a minor) must first sign and return to Administrator a release and declaration form, confirming compliance with these Official Rules, releasing Sponsor and Administrator from all liability related to the Contest and the Prize, and assigning all intellectual property rights in and to works completed by the selected entrant to Administrator, and waiving all moral rights therein. 

11. All entries become the property of Administrator and none will be returned or acknowledged. BY PARTICIPATING IN THIS CONTEST, ENTRANT RELEASES, DISCHARGES, INDEMNIFIES AND AGREES TO HOLD HARMLESS SPONSOR AND ADMINISTRATOR, THEIR RESPECTIVE PARENT COMPANIES AND AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY “RELEASEES”) FROM ANY CLAIMS, DAMAGES OR LIABILITY DUE TO ANY INJURIES, DAMAGES, OR LOSSES TO ANY PERSON (INCLUDING DEATH) OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THIS CONTEST OR ANY CONTEST-RELATED ACTIVITY OR FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE. Without limiting the generality of the foregoing, the Releasees assume no responsibility for (a) lost, delayed, late, destroyed, garbled or misdirected entries, which will be void; (b) technical, hardware, software, network, or telephone failures of any kind, lost or unavailable network connection, congestion or unavailability of any website, fraud, incomplete, failed or delayed computer transmissions, whether caused by the Administrator, users or by any of the equipment or programming associated with or utilized in the Contest; (c) or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a user's ability to participate in the Contest; or (d) any other technical or human error, or any fraud, misconduct or technical failures, that may impede the integrity of the Contest as determined by the Sponsors.

12. Subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) with respect to residents of Quebec, Administrator reserves the right, to
terminate, suspend or modify this Contest, in whole or in part, at any time and without
notice or obligation if, in Sponsor’s sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bug, tampering computer problem, unauthorized human intervention, fraud, printing errors, programming errors, technical failures, or any other cause beyond Administrator’s control, which, in the sole opinion of Administrator, corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event of early termination of the Contest, subject to the approval of the Régie in Quebec, a notice will be posted online and a random drawing to award all prizes may be conducted from among all eligible entries received prior to the time of termination. Administrator may disqualify any individual who tampers with the entry process, who acts in violation of these Official Rules or who attempts to or does undermine the administration, security or proper conduct of the Contest. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Proof of submission does not constitute proof of receipt.  In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e. the person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other party responsible for assigning e-mail addresses for the domains associated with the submitted e-mail address).

13. By entering this Contest, entrants agree to be governed by these Official Contest Rules, and consent to the use of their personal information by Administrator and
its authorized agents for the purpose of administrating this Contest. By accepting a prize, winners further consent to Sponsor’s use and disclosure of their names, address (city/province of residence only), biographical information, statements, voice, photograph and likeness in any advertising and publicity Sponsor may conduct relating to the Contest in any media or format whether now known or hereafter developed, including, without limitation, the Internet, at any time in perpetuity without further notice, consent or compensation.

14. For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

15. This Contest is subject to all applicable federal, provincial, municipal and local laws and regulations.

16.  Sponsor is an advertiser only, and is not responsible for the administration of the Contest or the fulfillment of prizes.
